Requirements

Utah requires filing with Utah Surplus Lines Association (SLAUT) within 60 days of policy effective date via InsCipher portal. SLAUT acts as the commissioner's authorized agent for examining transactions, collecting taxes, and collecting stamping fees. Tax: 4.25% + 0.18% stamping fee = 4.43% total. Joint and several liability applies to insurer, all brokers involved in the transaction, and the policyholder. Foreign insurers: $15M capital/surplus minimum (or Utah minimum, whichever greater). Commissioner may waive down to $4.5M with affirmative finding. Alien insurers: must be on NAIC Quarterly Listing. Annual renewal fee: $575 due March 1. Utah maintains eligible insurers list and export list. Recognizes NRRA ECP as of 7/21/2011. Industrial insured exemption only for captive insurers. Required policy disclosure statement must be attached/affixed to all policies. Does NOT allow domestic surplus lines insurers.

  1. 1ALL POLICIES MUST INCLUDE REQUIRED DISCLOSURE STATEMENT: "The insurer issuing this policy does not hold a certificate of authority to do business in this state and thus is not fully subject to regulation by the Utah insurance commissioner. This policy receives no protection from any of the guaranty associations created under Title 31A, Chapter 28."

IMPORTANT TAX LIABILITY: The insurer, all brokers involved in the transaction, and the policyholder are jointly and severally liable for payment of the premium tax and stamping fee. SLAUT AUTHORIZED AGENT: Utah Surplus Lines Association acts as the commissioner's authorized agent for: (1) collecting and remitting premium tax, (2) examining surplus lines transactions, (3) collecting stamping fee, and (4) prescribing forms and procedures for surplus lines producers. SURPLUS LINES PREMIUM DEFINITION: Includes policy fees, membership fees, required contributions, or any monetary consideration. However, courtesy filing fees may NOT be included as surplus lines premium when computing taxes and fees. TRUST REQUIREMENT: Surplus lines producers must hold premium taxes and stamping fees in trust until remitted to SLAUT.
